Resolved:

1. That Planning Application SOS/03/00010/FUL be REFUSED for the following reasons: -

(a) The planning application does not propose satisfactory solutions to deal with the significant environmental impact the development would generate. This results from the failure to provide for:

(i) displaced traffic (resulting from severance of Eastwoodbury Lane) and access to rail facilities to serve the projected increases in passenger throughput;

(ii) the provision of an adequate ‘Clear and Graded Area' associated with the reconfigured runway to meet with the safety requirements of the CAA as set out in CAP168; and

(iii) the submission of clear and convincing evidence to prove that very exceptional circumstances justify the demolition of St Laurence and All Saints Church which is a Grade I Listed Building of special architectural or historic interest.

The application therefore contravenes Policies BIW8, BIW9, BE7, T10, and HC3 of the Essex and Southend-on-Sea Replacement Structure Plan and contravenes Policies T17 and C2 of the Southend-on-Sea Borough Local Plan.

2. That Listed Building Application SOS/03/00011/LBC be REFUSED for the following reason:

(a) The listed building application proposes the total demolition of St Laurence and All Saints Church which is a Grade I Listed Building of special architectural or historic interest. The building is in beneficial use and in good condition, therefore, a very exceptional case is required to justify the proposal. In the absence of clear and convincing evidence to prove that demolition would bring substantial benefits for the community, the approval of the application would be contrary to National Policy in PPG 15 and to Policy HC3 of the Essex and Southend-on-Sea Replacement Structure Plan and Policy C2 of the Southend-on-Sea Borough Local Plan which seek to protect listed buildings.

Mr McNicholas spoke as an objector to application SOS/03/00010. Mr A Walters on behalf of the applicant responded.

Rev.Ransom spoke as an objector to application SOS/03/00011. The applicant did not respond.
1221The Council received a report by the Director of Technical & Environmental Services No DTES 03/61. This provided an update on this application which had been referred to it under Council Procedure Rule 39

Mr. ODwyer of 65/66 Eastern Esplanade, Southend-on-Sea spoke as an objector to the application. The Agent responded.

The Council indicated that it had no objection to this application subject to resolution of the issues referred to in the resolution below.
